ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 420 of I.P.C in Crime.No.25 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that there are totally 6 accused in this case and the petitioner herein is A1. The allegation is that the petitioner has approached the defacto complainant and borrowed a sum of Rs.5,00,000/- with a false assurance that he will arrange loan under Prime Minister Yogana scheme. Thereafter, the petitioner fraudulently obtained the power of attorney for the property belonging the defacto complainant, and thereby cheated him. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and is no way connected with the alleged offence. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that the petitioner along with other accused borrowed a sum of Rs.5,00,000/- and also fraudulently obtained the power of attorney for the property belonging the defacto complainant and thereby cheated him. He would further submit that the investigation is still in preliminary stage. Hence, he vehemently opposed to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5.Consideration the facts and circumstances of the case and the nature of offence and the stage of investigation, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
