ORDER

The petitioner has filed this Writ Petition praying for issuance of a Writ of Mandamus to direct the first respondent to take up appeal No.60/2015 filed on 11.12.2015 and dispose of the same within a date that may be fixed by this Court.

2. Though very many contentions are raised in the Writ Petition, at the time of hearing the Writ Petition, learned counsel for the petitioner submitted that it would suffice if a direction is issued to the first respondent to dispose of appeal No.60 of 2015, filed on 11.12.2015.

Learned Government Advocate appearing for the respondents submitted that the already notice was sent to the petitioner on 08.02.2016 and intimation was given by the first respondent to the petitioner stating that the appeal would be taken up for disposal and the date of hearing will be intimated to him. However, learned counsel for the petitioner submitted that till date, the petitioner has not received any information.

4. Taking into consideration the above submissions of the learned counsel on either side and without going into the merits of the case, this Court directs the first respondent to consider the said appeal in Appeal No.60 of 2015 filed by the petitioner on 11.12.2015 and after conducting enquiry and giving an opportunity of personal hearing to the petitioner and necessary parties, pass appropriate orders and dispose of the said appeal, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner and it is for the first respondent to decide the same.

5. With the above observations and directions, the Writ Petition is disposed of. No costs.
