CR.NO.288 OF 2018.

Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed on their in Crl.O.P.No.14860/2018 order dated 08.06.2018 on condition that they should report before the respondent daily 10.30 a.m until further orders.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.S.L.VENKATESAN Advocate for the petitioner and of MR.M.PRABHAVATHI ADDL.PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- The petitioner filed this petition for relaxing the condition imposed by this Court in Crl.O.P.No.14860 of 2018 for the offences punishable under Sections 294 (b), 506(i), 109, 302 of IPC in Crime No.288 of 2018, while granting bail.

2. The learned counsel appearing for the petitioner would submit that the petitioner is complying with the condition from 12.06.2018 to till the date without fail and that the charge sheet has already been filed before the Judicial Magistrate Court, Cheyyar and also her appearance date has been fixed on 20.08.2018. Further, he would submit that since the petitioner is working as coolie and her family depends upon her income only, she is very difficulty to comply with the conditions imposed by this Court. Hence, he seeks for relaxation.

3. The learned Additional Public Prosecutor (Crl.Side) appearing for the State submitted that the petitioner is complying with the conditions regularly and the charge sheet has already been filed before the trial Court.

4. Considering the nature of the offence and the submissions made by the learned counsel on either side, the condition imposed on the petitioner in Crl.O.P.No.14860 of 2018, dated 08.06.2018 that the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders is modified to the effect that "the petitioner is directed to appear before the Judicial Magistrate Court, Cheyyar on every Monday at 10.00 a.m, until further orders"
