THAMILSELVI CRIMINAL MISCELLANEOUS PETITION No.601 of 2022 IN CRL OP.982/2022 1 PARASURAMAN [ PETITIONERS ] 2 SETTU Vs STATE REP BY [ RESPONDENT ] THE SUB INSPECTOR OF POLICE, KADALADI POLICE STATION, TIRUVANNAMALAI DISTRICT (CRIME NO.713/2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Modify the Condition No.6 (d) that the petitioners shall stay at Cuddalore and report before the Town Police Station daily at 5 p.m., for a period of 4 Weeks and thereafter report before the respondent police as and when required for interrogation, imposed by this Hon'ble Court.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S SATHIYARAJ E., Advocate for the petitioner and of MR. A.GOKULAKRISHNAN, Additional Public Prosecutor on behalf of the Respondent the court made the following order:- The Petitioners have filed this petition seeking to modify the condition in para 6(d) imposed by this Court in Crl.O.P.No.982 of 2022 for the offences punishable under Sections 147, 148, 294(b), 323, 324 & 307 of IPC r/w 294(b), 323, 324 & 307 of IPC, in Crime No.713 of 2021, while granting bail.
2. The learned Counsel appearing for the petitioners submitted that the petitioners are complying with the conditions from 14.01.2022 till date and it is very difficult them to stay and accommodate in Cuddalore, since, the petitioners being a native of Tiruvannamalai District and they are sole bread winner of the family. Hence, the present modification petition has been filed.. 3.The learned Additional Public Prosecutor submitted that the petitioners are complying with the conditions regularly. 4.Considering the facts and circumstances of the case, the condition already imposed by this Court is modified and the petitioners are directed to appear before the respondent police on every Monday at 5.00 p.m.,until further orders. This petition is ordered.
