O R D E R

The petitioner has filed the above Writ Petition to issue a writ of mandamus directing the respondents 1 to 3 to initiate speedy and appropriate action to forbear the 4th respondent or any other person from unauthorisedly desilting of the public irrigation canal and from laying of road in Survey No.364 at Venkatathri Agaram Village, Villupuram Taluk and District by passing appropriate orders on the petitioner's representations dated 01.12.2016 and 20.02.2017 within a time frame. https://hcservices.ecourts.gov.in/hcservices/

2.Mr.M.Ravi, learned counsel appearing for the petitioner submitted that inspite of the petitioner's representations dated 01.12.2016 and 20.02.2017 given to the respondents to forbear the 4th respondent from desilting irrigation canal and from laying the road, the respondents have not taken any action so far.

3.Mr.Era Premnath, learned Government Advocate taking notice for the respondents 1 to 3 submitted that the 2nd respondent may be directed to consider the petitioner's representations in accordance with law, after giving notice to the 4th respondent. 4.Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for by the petitioner, without expressing any opinion with regard to the merits of the case, I direct the 2nd respondent to consider the petitioner's representations dated 01.12.2016 and 20.02.2017 and pass orders, after giving notice to the 4th respondent, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

5.With these observations, the Writ Petition is disposed of. No costs.
