Mr.C.Jayaprakash, Govt Advocate Order This writ petition has been filed for a mandamus to direct the respondents to execute the revenue recovery order, based on the proceedings of the first respondent dated 30.09.2024, within a time frame to be fixed by this Court.
2.The petitioner is having the benefit of a judgment passed in his favour under Section 138 of the Negotiable Instruments Act against the accused Murugesan. The conviction order passed against the accused Murugesan in Section 138 proceedings has also attained finality as per the judgment passed in favour of the petitioner by the Criminal Court and the compensation amount was directed to be paid by the accused to the petitioner. Till date, the said compensation amount fixed by the Criminal Court has not been paid to the petitioner. Therefore, the petitioner approached the respondents for recovery of the said amount from the accused Murugesan. The first respondent has also passed the proceedings dated 30.09.2024 through which the first respondent has agreed to take steps to recover the amount payable by the accused Murugesan to the petitioner.
3.The grievance of the petitioner in this writ petition is that despite the proceedings issued by the first respondent on 30.09.2024, till date, no further steps have been taken by the first respondent to recover the amount payable by the accused Murugesan to the petitioner. Under those circumstances, this writ petition has been filed to execute the revenue recovery order, based on the proceedings of the first respondent dated 30.09.2024.
4.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents.
5.No prejudice would be caused to the respondents if the second respondent is directed to implement the proceedings of the first respondent dated 30.09.2024, within a time frame to be fixed by this Court. 6.For the foregoing reasons, this writ petition is disposed of by directing the second respondent to implement the proceedings of the first respondent dated 30.09.2024, within a period of 8 weeks from the date of receipt of a copy of this order. No costs.
