Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, to call for the records from the 2nd respondent relating to the order dated 4th June 2002 in I.D.No.521 of 1999, quash the same. O R D E R

The preliminary award dated 04.06.2002 passed in I.D.No.521 of 1999 is sought to be quashed.

2. An industrial dispute was raised in the year 1999 and a preliminary award was passed on 04.06.2002, regarding the validity and fairness of the domestic enquiry conducted by the Management. The writ petition was filed in the year 2002. On account of the efflux of time, this Court is of the considered opinion that no meaningful purpose in the event of adjudicating the grounds, at this length of time. Under these circumstances, the parties are at liberty to make their grounds before the Labour Court in the industrial disputes, admittedly, pending before the Labour Court, Coimbatore.

3. The Labour Court is directed to adjudicate the industrial dispute on merits and in accordance with law by affording opportunity to all the parties concerned as expeditiously as possible and preferably within a period of six months from the date of receipt of a copy of this Order. The Labour Court shall not grant any unnecessary adjournments to the parties. The adjournments shall be granted on certain genuine grounds and by recording the reasons for such adjournments. The respective parties are directed to co-operate for earlier disposal of the industrial disputes. All the grounds raised in the present writ petition shall be raised by the parties in the industrial disputes, to be adjudicated by the Labour Court as expeditiously as possible.

4. With these directions, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
