Mrs.Viji Alias Chithiravadivu v. The Administrator General And The Official Trustee Tamil Nadu

This application is filed by the applicant for a direction to the Administrator General and Official Trustee of Tamil Nadu (AG & OT) to allot the premises situated at Door No.17, Ground Floor, Woods Road, Royapettah, Chennai - 600 002, measuring an extent of 124 sq. ft., on lease, to the applicant.

It is stated in the affidavit filed in support of this application that the applicant wants to occupy the above said premises so as to start a new coffee and snacks shop for commercial purpose; and that, she is ready to pay a monthly rent of Rs.7,700/- and deposit a sum of Rs.77,000/- towards advance for the said premises.

3. During the course of hearing, the learned AG & OT stoutly refuted the monthly rent amount offered by the applicant for the subject premises and submitted that the property is located in a prime area, where the market rent is very high.

4. In reply, the learned counsel for the applicant submitted that the applicant is now inclined to pay a sum of Rs.20,000/- per month as rent for the subject premises, for which, there is no serious objection by the learned AG & OT.

5. In view of the consensus arrived at between the parties, the applicant is directed to pay a sum of Rs.20,000/- (Rupees Twenty Thousand only) per month towards rent for the subject premises and the learned AG & OT is directed to execute a lease deed for the above rent with other usual conditions followed by the office of the AG & OT.

6. Accordingly, this application is ordered.
