Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to consider the petitioner dated 24.12.2020 for rectification of defects in the revenue records with regard to erroneous classification of lands measuring about 0.54.5 Hectares (1.35 acres) in Survey No.78/2 of Enusonai Village, Krishnagiri District based on the report of 3rd Respondent vide Na.Ka.4510/2016/A2 dated 30.12.2016 within the time to be stipulated by this Hon'ble Court.

ORDER

The petitioner has approached the first respondent for re-classification of certain land in Sy.No.78/2 of Enusonai Village, Krishnagiri District, which has been classified in the Revenue Record as Anadeenam. The matter is pending with the first respondent/DRO since 2016.

2.Mr.S.N.Parthasarathi, learned Government Advocate took notice for the respondents and made a statement on https://hcservices.ecourts.gov.in/hcservices/

instructions that so far as correcting certain errors or any wrong classification made during UDR, the District level Authorities have got power to make the correction, whereas, reclassification of the kind which the petitioner now seeks, the power vests with the Commissioner of Land Administration. 3.The said statement of the learned Government Advocate is recorded.

4.This Court therefore, requires the petitioner to approach the CLA for the purpose, if he is so desirous. Having stated thus, this Court also records its disappointment as to why this simple information was not transmitted to the petitioner even at the earlier point of time and why the Authorities slept over the matter for five years and made the petitioner approach this Court just to pass on this information. This Court would appreciate if the officials concerned realized that this Court is not a RTI extension counter for its Office.

5.The Writ Petition is disposed of accordingly. No costs.
