C.M.P.Nos.1374, 1377 & 1380 of 2024 in S.A.No.573 of 2012 G.ARUL MURUGAN, J., These miscellaneous petitions in C.M.P.Nos.1374, 1377 & 1380 of 2024 are filed to (i) condone the delay of 1795 days in filing the petition to bring on the legal heirs of the deceased 2nd appellant, (ii) set aside the abatement, (iii)bring on records of the proposed parties/legal heirs of the deceased 2nd appellant, respectively.

It is stated that the petitioners' mother/2nd appellant in this Second Appeal died on 13.09.2018 and after obtaining the death certificate and legal heir certificate, they have informed the counsel, who has later taken steps to file above petitions. After the death of their mother, it took time for them to find the details of the counsel and contact him and also collect the certificates filed in the above petitions. A copy of the death certificate and legal heir certificate have been filed along with these petitions. 3.

Heard the learned counsel for the petitioners. The learned counsel for the respondents has no serious objection.

Perused the affidavit filed in support of these petitions and also having satisfied with the reasons, these C.M.P.s are ordered. Registry is directed to make necessary amendments in the second appeal in S.A.No.573 of 2012. 5.
