Respondents Petition under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the 1st respondent to dispose the petitioner's appeal dated 30.01.2019 challenging the order passed by the 2nd respondent dated 14.12.2018 in R.C.No.5/2018 (ST) in a time bound manner fixed by this Court in accordance with law.

ORDER

Heard Mr.R.Marudhachalamurthy, learned counsel for the petitioner and Ms.A.B.Reehana Begham, learned Government Advocate accepting notice on behalf of the respondents. 2.With consent on either side, this writ petition is taken up for final disposal.

3.This writ petition has been filed to dispose of the appeal dated 30.01.2019, filed by the petitioner before the first respondent, as against the order passed by the second respondent dated 14.12.2018.

4.Though the second respondent in his order dated 14.12.2018, stated that the petitioner should await the outcome https://hcservices.ecourts.gov.in/hcservices/

of the civil litigation, which is pending before the Sub Court, Sankari in O.S.No.2 of 2012, has granted liberty to the petitioner to file an appeal before the first respondent, if he is aggrieved by his order. Accordingly, the petitioner has filed an appeal before the first respondent on 30.01.2019. 5.The learned Government Advocate appearing for the respondents submits that minimum of twelve weeks time may be granted to the first respondent to dispose of the petitioner's appeal dated 30.01.2019 on merits.

6.In the light of the stand taken by the learned Government Advocate, this writ petition stands disposed of by directing the first respondent to dispose of the petitioner's appeal dated 30.01.2019, if it is found to be in order within a period of twelve weeks from the date of receipt of a copy of this order, after affording an opportunity of personal hearing to the petitioner. No costs.
