The petitioner, who was arrested and remanded to judicial custody on 30.04.2022 for the offences under Section 366 of IPC and Section 4 of POCSO Act in Cr.No.06 of 2022, seeks bail.

2.The case of the prosecution is that the petitioner along with other accused have committed penetrative sexual assault on the minor victim girl aged about14 years. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that he has not committed any offence as alleged by the prosecution and he is ready to abide by any stringent condition that may be imposed by this Court. Hence he prays for grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) for the respondent submitted that the petitioner along with other accused took the victim girl to the house of A1 and they had committed penetrative sexual assault on her who is aged about 14 years. vkr the occurrence place and shouted on hearing her voice and afterwards, the defacto complainant lodged the complaint. He also submitted that the statement under Section 164 Cr.P.C has been recorded from the victim girl. However, he vehemently opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and the gravity of offence committed by the petitioner, this court is not inclined to grant bail to the petitioner.
