Respondents Writ petition filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the 1st respondent to consider and dispose of the petitioner's representation dated 05.07.2016 with regard to payment of his earned leave encashment benefits for the leave period of 125 days.

ORDER

The relief sought for in this writ petition is for a direction to the first respondent to consider the representation submitted by the writ petitioner dated 5.7.2016 in relation to the payment of his Earned Leave Encashment benefits for the leave period of 125 days.

2. Heard Mr.M.Velmurugan, learned counsel appearing for the writ petitioner, Mr.T.S.Baskaran, learned counsel appearing for the first respondent and none appeared on behalf of the second respondent.

3. The learned counsel appearing for the writ petitioner submits that the writ petitioner was appointed as Assistant Administrative Officer in the United India Insurance Company Limited and further he was promoted as Administrative Officer https://hcservices.ecourts.gov.in/hcservices/

and thereafter to the post of Assistant Manager. The post of Assistant Manager was re-designated as Deputy Manager and the writ petitioner was terminated from service with effect from 13.5.2011. Further he made a request to settle the dues in respect of the payment of his Earned Leave Encashment benefits for the leave period of 125 days and in this regard, he made a representation to the first respondent on 5.7.2016.

4. Thus, without going in to the merits of the case, the first respondent is directed to consider the representation submitted by the writ petitioner on 5.7.2016 and pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

5. Accordingly, the writ petition stands disposed of. Consequently connected miscellaneous petition is closed. However, no order as to costs.
