The Advocate Commissioner appointed by this Court submits that warrant could not be executed, since the fees payable to the Chartered Engineer is on the higher side and the plaintiff is also not willing to bear the same.

The learned counsel for the plaintiff submits that a direction may be given to the Advocate Commissioner to seek the assistance of Civil Engineer instead of Chartered Engineer. The learned counsel for the plaintiff is directed to file a memo to that effect after serving a copy of the same on the defendants' counsel to enable him to get instructions from his clients.

Post the matter on 07.02.2025.
