It is submitted by the learned counsel for the petitioner that the 2nd respondent had expired and that they are unable to obtain particulars of the legal heirs. Since the petitioner herein has challenged the award, which is for reinstatement with all benefits, the presence of the 2nd respondent is imminent. Since the petitioner has failed to take steps to implead the legal heirs of the 2nd respondent, the present Writ Petition is dismissed for default. No costs.
