Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 3rd respondent to consider the representation dated 29.07.2019 and consequently direct the 3rd respondent to sanction the medical claim of the petitioner within a time period stipulated by this Court.

O R D E R

This writ petition has been filed for issuance of a writ of mandamus directing the 3rd respondent to consider the representation made by the petitioner on 29.07.2019 and to sanction the medical claim to the petitioner.

2.The case of the petitioner is that he was working as a shop supervisor in TASMAC shop. The petitioner suffered with cardiac arrest and he was immediately admitted in hospital and he was treated and discharged on 06.07.2019. According to the petitioner, he is entitled for reimbursement of the medical expenses. Therefore, he made a representation to the 3rd respondent and the 3rd respondent, in spite of giving an assurance that it will be sanctioned, did not take any action. The petitioner therefore, approached the 2nd respondent who is the competent authority to finalize the medical claim. Both the 2nd and 3rd respondents did not take any steps to finalize the medical claim made by the petitioner. Therefore, the present writ petition has been filed before this Court seeking for appropriate directions.

3.Heard Mr.K.S.Kaviarasu, learned counsel appearing on behalf of the petitioner and Mr.P.S.Sivashanmuga Sundaram, learned Special Government Pleader appearing on behalf of the 1st respondent and Mr.K.Sathish Kumar, learned Government Advocate appearing on behalf of the 2nd and 3rd respondents. 4.Taking into consideration the facts and circumstances of the case and also the limited relief that has been sought for in this writ petition, there shall be a direction to the 3rd respondent to consider the representation made by the petitioner on 29.07.2019, making a medical claim, and pass appropriate orders, within a period of four weeks from the date of receipt of copy of this order. The petitioner is directed to make a fresh representation to the 3rd respondent along with a copy of the representation dated 29.07.2019 and a copy of this order.

5.This writ petition is disposed of with the above directions. No Costs.
