Writ petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 3rd respondent to consider the representation of the petitioner dated 30.01.2018 and consider the petitioner's name for temporary promotion by including his name in the list of persons for promotion for the Post of Line Inspector.

O R D E R

The Writ Petition has been filed seeking to issue a Writ of Mandamus, directing the 3rd respondent to consider the representation of the petitioner dated 30.01.2018 wherein the petitioner sought for promotion to the post of Lineman from the post of Wireman. 2.

Learned Counsel for the petitioner submitted that the petitioner was appointed as a Contract Labour in the year 1996 by the respondent Management and he has been continuously serving as a Muzdoor Trainee for about ten years. Thereafter, he was promoted as a Wireman on 21.11.2014. While so, the Chairman of the Tamil Nadu Electricity Board, the 1st respondent herein, sent a Circular to implement the seniority list on the basis of the merit on considering the eligible candidates. The petitioner is a senior most person and his name was also shown in Sl.No.201 of the Seniority List of Wiremen prepared on 31.05.2015. But, till date, for the reasons best known to the respondent department, he has not been given promotion. Therefore, a representation dated 30.01.2018 has been made seeking promotion. But, there is no response for the same. Hence, a direction is sought for to dispose of the said representation on merits.

This Court is not able to find any merit in the Writ Petition for the simple reason that when the name of the petitioner has been shown in Sl.No.201 in the Seniority List of Wiremen prepared on 31.05.2015, the petitioner could not make out a case that his juniors who are placed below Sl.No.201 have been given promotion. 4.

In the result, the Writ Petition fails and the same is accordingly dismissed.

No costs.

Consequently, connected Miscellaneous Petition is also closed.
