When the matter was taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the first respondent police 1/4
submitted that on the same ground, the petitioner has filed a revision petition before the trial Court and the same is pending in Crl.M.P.No.35040 of 2023.

At this juncture, the learned counsel appearing for the petitioner submitted that the discharge petition has been pending for the past two years. Since there has been no progress, he has approached this Court. Hence, he seeks permission of this Court to withdraw this Criminal Original Petition in order to pursue the discharge petition and made an endorsement to that effect. He further prayed that liberty may be granted to approach this Court at a later point of time and also seeks a direction to the learned trial Judge to dispose of the discharge petition at the earliest. 3.
In view of the submission and endorsement made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as withdrawn, with liberty as prayed for. Consequently, the connected Criminal Miscellaneous Petitions are closed. 4.
The learned trial Judge is directed to dispose of the discharge petition within a period of four weeks from the date of receipt of a copy of this order.
