The respondents 1 and 2 remained exparte before the Tribunal and hence, notice to them is dispensed with.

Mr.S.Arunkumar, learned counsel takes notice for the third respondent.

Heard the learned counsel for the petitioner and the third respondent.

Being satisfied with the reasons assigned in the affidavit filed along with the petition, the delay of 941 days in filing the appeal is condoned.

It is made clear that petitioner is not entitled to claim interest for the delay period of 941 days on the enhanced award amount, in case of his success in the appeal.

Registry is directed to number the civil miscellaneous appeal, if it is otherwise in order. Registry is directed to print the name of Mr.S.Arunkumar, counsel for the 3rd respondent, at the time of admission.
