J U D G M E N T

Pursuant to the orders of this Court, the appellant and the 1st respondent appeared before the Mediation and Conciliation Centre, High Court of Madras, Chennai on 09.11.2017 and had settled the matter by filing a memorandum of compromise dated 08.11.2017.

2. The Mediation and Conciliation Centre also recorded that the parties had settled the matter as per the terms cited in the Mediation Agreement.

3. Mr.V.Raghavachari, learned counsel appearing for the appellant submitted that since the dispute between the parties has been settled, the Registry may be directed to refund the court fee paid by the appellant.

4. In view of the same, the Appeal stands disposed of in terms of the memorandum of compromise dated 09.11.2017 and the terms of the compromise shall form part and parcel of the decree in the above Appeal.

5. The Registry is directed to refund the court fee paid in the Fist Appeal to the appellant. The Registry is also directed to hand over the cheque to the appellant or his agent identified by the learned counsel appearing for the appellant. No costs. Consequently, connected miscellaneous petition is closed.
