A.No.856 of 2023 in C.S.No.179 of 2016 N.SESHASAYEE.J., This application has been filed to appoint Advocate Commissioner in pursuance to the orders of this Court in A.No.5826 of 2019 in C.S.No.179 of 2016 dated 12.10.2020, to demolish the theatre with the help of the surveyor after getting necessary approval from Corporation and divide the suit property by metes and bounds to the plaintiffs and defendants in the ratio of 50: 50.

2.This Court appoints Mr.S.Patrick, Phone No.9659637383, as an Advocate Commissioner. Rs.50,000/- (Rupees Fifty Thousand only) has been fixed as remuneration to the Commissioner.

3.Both sides are required to share this remuneration. It is underscored that the defendant is required to share part of the commissioner's remuneration without prejudice to his right in the pending Intra Court First appeal against the preliminary decree.
