Writ Petition filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorarified Mandamus to call for the records relating to the order passed by the third respondent in his proceedings No.

E28015/250/Adm.II/Pension/No.02018/906 dated 01.05.2018 and quash the same and further direct the third respondent to sanction the disability extraordinary pension to the petitioner for the period from 20.03.2002 to till date and to pay the same regularly.

O R D E R

The Writ Petition has been filed seeking the aforesaid relief.

2.Mr.L.J.Vengatesh who accepts notice for the respondent challenges the maintainability of the Writ Petition before this Court, though, the petitioner resides after his retirement in the jurisdiction of this Court. Inasmuch as no cause of action arose within the territorial jurisdiction of this Court.

3. Heard the Counsel for the petitioner as well as Mr.L.I.Vengatesh, Counsel for the respondent.

4. After arguing on the maintainability and hearing the submission of the counsel for the respondent, counsel for the petitioner seeks permission to withdraw this Writ Petition to file in appropriate forum having jurisdiction and also makes endorsement in this regard.

Hence, based on the submission made by the learned counsel appearing for the petitioner, and endorsement made by the counsel for the petitioner, this Writ Petition is dismissed as withdrawn, to approach appropriate forum. However, such withdrawal shall not stand in the way of the petitioner in any manner to approach the appropriate forum ventilating his grievance, if so adviced. No costs.
