JUDGMENT

The second appellant and the respondent is present. The learned counsel for both sides have filed a compromise memo stating that the matter has been settled between the parties and submitted that the suit may be decreed in terms of the compromise memo.

2. In view of the compromise between the parties and as the parties have also appeared before this Court, the compromise memo is recorded.

3. Accordingly, this Second Appeal is disposed of in terms of the compromise memo and the compromise memo shall form part and parcel of the decree and judgment. Consequently, the connected miscellaneous petition is closed. No cost.
