Prayer: Criminal Original petition filed under Section 482 of Code of Criminal Procedure, to withdraw the M.C.(DV).No. 3 of 2013 from the file of the learned Judicial Magistrate No.II, Poonamallee and transfer the same to the III Additional Family Court at Chennai.

ORDER

This petition has been filed seeking for transfer of all proceedings in M.C.(DV).No. 3 of 2013 pending on the file of the learned Judicial Magistrate No.II, Poonamallee to III Additional Family Court at Chennai.

The learned counsel for the petitioner submitted that the petitioner has already filed a maintenance case against the respondent in M.C.No.274 of 2017 and the same was pending before the learned III Additional Family Court, Chennai. The learned Counsel further submitted that the domestic violence proceedings can also be transferred before the same family Court, so that the parties can attend to the proceedings before the same Court. 3.Taking into consideration the facts and circumstances of this case and the convenience of the petitioner, who is the wife and her minor child, this Court is inclined to withdraw the proceedings in M.C.(DV).No. 3 of 2013, on the file of the https://hcservices.ecourts.gov.in/hcservices/ learned Judicial Magistrate No.II, Poonamallee and transfer the

same to learned III Additional Family Court, Chennai. The case records shall be transferred to the III Additional Family Court at Chennai, within a period of three weeks from the date of the receipt of the copy of this order.
