O R D E R
The Criminal Revision has been filed as against the Judgment and sentence passed by the learned II Additional Sessions Judge,
Chidambaram in C.A.No.11/2023 dated 22.12.2023 and convicted the petitioner for an offence under Section 294(b) and 307 of IPC and sentenced to under Section 294(b) of IPC, one month simple imprisonment and to pay a fine of Rs.200/-, in default, to undergo one week and imprisonment and under Section 307 of IPC, sentenced to undergo seven years of RI and to pay a fine of Rs.1000/- in default, three months imprisonment. The above said sentences shall run concurrently. Challenging the same, the petitioner has filed Revision and the present miscellaneous petition seeking suspension of sentence of imprisonment.
2. The learned counsel for the petitioners has raised several arguable grounds insofar the petitioner and it will take some more time for this Court to take up the criminal revision and to dispose of the same. The learned counsel further submitted that the petitioner is in prison for more than six months.
3. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that apart from this case, there are eight cases pending as against the petitioner, out of which, five cases have ended and
three cases are pending.
4.In the facts and circumstances of the case, the Criminal Miscellaneous Petition is ordered and the punishment of imprisonment imposed as against the petitioner is hereby suspended and he is directed to be released on bail on the following conditions: a) the petitioner shall execute a bond for a sum of Rs.10,000/- to the satisfaction of the learned Judicial Magistrate-I, Chidambaram along with two sureties for a like sum;
b) the petitioner shall report before the Court below on the first working day of every week at 10.30 AM,till the disposal of the revision. 18.06.2024 rli Note: Issue order copy on 19.06.2024 To
