ORDER

This writ petition is filed to direct the respondents 1 and 2 to take necessary action and classify the land as 'patta land' instead of 'Tharisu land' based on the representation dated 11.05.2018 and pass such further or other orders.

Learned counsel for the petitioner would submit that the petitioner's husband executed a gift deed in favour of petitioner, in respect of land measuring about 0.15 cents in S.No.419/1B1 at No.64, Mel Ayanambakkam Village, Thiruvallur District, Madhuravoyal Taluk. When the petitioner intends to transfer the patta on her name, in the online portal, the said land was classified as Tharisu land and not patta land. In order to rectify the said error, the petitioner has made several representations before the respondents. However, the same was not considered, as on date. Hence, this writ petition.

3. Learned Government Advocate appearing for the respondents would submit that the petitioner has made a representation before the Revenue Divisional Officer, who forwarded the same to the Tahsildar, the second respondent herein on 31.01.2006 and the same is yet to be decided.

4. Heard the learned counsel on either side and perused the materials available on record.

5. In the case on hand, the subject property belongs to petitioner's husband, who executed a gift deed in favour of petitioner. The petitioner's family is in possession of the said land and doing cultivation for more than 20 years. Therefore, the petitioner is entitled for re-classification and patta.

6. Such being the case, the second respondent is directed to re-classify the land as 'patta land' instead of 'tharisu land' and issue patta in favour of the petitioner, within a period of eight weeks from the date of receipt of a copy of this order. In regard to issuance of patta, the petitioner is directed to make appropriate online application before the respondents. With the aforesaid directions, this writ petition stands disposed of. No costs.
