A.No. 6851 of 2016 in C.S.No. 693 of 2016 R.SUBRAMANIAN, J.

The suit in C.S.No. 693 of 2016 has been filed by the plaintiffs seeking partition and separate possession of their 2/9th share in the suit schedule properties. The case of the plaintiffs is that the properties belongs to the Joint family of which the deceased N.Natarajan was the Karta.

2. Pending the said suit, the applicant who claims to be the son of the first plaintiff has come forward with this application seeking to implead himself in the suit. In as much as, the plaintiff would claim that the properties are ancestral joint family properties, the applicant, as a son gets a right by birth in the properties. Hence, he is the necessary party to the suit. Despite notice, no counter has been filed for near two years. Hence, this application is allowed. The applicant is impleaded as 8th defendant in the suit.

3. The counsel to carry out amendment and file amended copies of the plaint by 15.04.2019.
