O R D E R
The prayer sought for herein is for a Writ of Mandamus directing the 3rd respondent to measure and fix the boundary stone in respect 2 of the property of the petitioner comprised in Ward No.A, Block 68, Town Survey No.2 and 3 situated in Tirupur Corporation, Tirupur North Taluk, Tirupur District.
2. In order to survey the land of the petitioner situated at Ward No.A, Block 68, Town Survey No.2 and 3 situated in Tirupur Corporation, Tirupur North Taluk, Tirupur District, the petitioner had given an application on 27.12.2021 and paid the necessary fee. Thereafter, even though two times notices have been issued fixing the survey date, on that date even though the petitioner was waiting in the property, there was no response from the respondents and no one had come to survey the property. Therefore, the petitioner has approached this Court by filing the present writ petition.
3. Heard Mr.P.Sriramkrishnan learned counsel for the petitioner and Mr.P.Sathish, learned Additional Government Pleader for the respondents.
4. Learned Additional Government Pleader would submit that the said application dated 27.12.2021 would be considered and immediately date would be fixed for conducting the survey and on the date to be fixed in this regard, the 2 / 4
2nd and 3rd respondents certainly would complete the survey and do the needful on the application of the petitioner.
5. Having regard to the said submission made by the learned Additional Government Pleader, this Court is inclined to dispose of this writ petition with the following order.
"That there shall be a direction to the 2nd and 3rd respondents to consider the application of the petitioner dated 27.12.2021 for conducting survey of the petitioner's land and fix a date for the said purpose. On the said date, the 2nd and 3rd respondents shall conduct the survey and identify the four boundaries of the petitioner's land and communicate the same to the petitioner. The aforesaid shall be undertaken by the 2nd and 3rd respondents within a period of four weeks from the date of receipt of a copy of this order."
