ORDER
The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 326(a), 303(2) of BNS,2023 r/w. 199A of Motor Vehicles Act 1988 in Crime No.02 of 2026, seek anticipatory bail.
2. The allegation against the petitioner is that the petitioner was involved in illegally quarrying 1 unit of Murambu sand from the Ranipet District Odai. Hence the complaint.
3. The learned counsel for the petitioner would submit that the petitioner is innocent and has not committed the offences alleged by the defacto complainant. He also submitted that the petitioner is ready to abide with any conditions that may be imposed by this Court, and therefore, he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.side) would submit that investigation in this case is pending and the petitioner was involved in illegally quarrying 1 unit of Murambu sand from Odai. Hence, she vehemently opposed to grant anticipatory bail to the petitioner.
5. Considering the fact that the petitioner was involved in illegally quarrying murambu sand from the odai and also damaged the water body. Hence, I am not inclined to grant anticipatory bail to the petitioner and if the petitioner is granted bail, he will involve in similar activities. Accordingly, this Criminal Original Petition is dismissed.
