The Water Base Limited v. M/S.Kartavi Aqua

O.A.No.1274 of 2020 N. SATHISHKUMAR, J.

This application has been filed for direction to the respondent to furnish security for a sum of Rs.3,21,65,823/-, within the time fixed by this court.

2. When the matter is came up before this court, Mr. Anirudh Krishnan, learned counsel appearing for the applicant and Mr.Adithya, learned counsel for the respondent submitted that they have agreed to refer the matter before the Arbitrator.

3. Since both the counsels have given consent for appointment of Arbitrator, this court is inclined to appoint Mr.Arun C.Mohan, Advocate, as Arbitrator, without waiting for filing another application under Section 11 of the Arbitration and Conciliation Act.

4. Accordingly, it is ordered as follows:

i) That Mr.Arun C. Mohan, Advocate, Ceebros Building, D4, III Florr, 32, Cenotaph Road, Teynampet, Chennai 600 018, Contact No.9600020715 be and is hereby appointed as Arbitrator to enter upon the reference and adjudicate the disputes inter se the parties.

ii) That the learned Arbitrator appointed herein, shall after issuing notice to the parties and upon hearing them, pass an award as expeditiously as possible, preferably within a period of six months from the date of receipt of the order.

iii) That the learned Arbitrator appointed herein shall be at liberty to fix his remuneration and other incidental expenses, which shall be borne by the parties equally.

5. It is open to the parties to raise all the legal issues before the Arbitrator.

6. The Original Petition is ordered accordingly, leaving the parties to bear their own costs.
