The petitioner, who apprehends arrest for the alleged offences punishable under Sections 174(3) of Criminal Procedure Code altered into 306 of I.P.C in Crime No.211 of 2021, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner used to send some whatapp message to one Sandhya who is the wife of Vijayakumar which caused disturbance to the matrimonial life of the deceased. On the date of occurrence the Vijayakumar questioned the deceased about the whatsapp messages by the petitioner, due to which she committed suicide. Hence the complaint.

3.The learned counsel for the petitioner would submit that there was some family dispute between the petitioner and the deceased, that apart

he has not committed any offence as alleged by the prosecution. Hence prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) would submit due to the misbehaviour of the petitioner by sending messages to the deceased put the mental stress, she has committed suicide. Hence he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and the nature of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the Criminal Original Petition is dismissed. 06.02.2023 smn
