Defendants Prayer : Civil Suit filed under Order VII Rule 1 of CPC read with Order IV Rules 1 of Madras High Court Original Side Rules, praying to pass a decree and judgement :

(a) directing the defendants 1 to 6 to render accounts for the share of the plaintiff in the capital assets, profits and determine the dues of the plaintiff in the 1st defendant partnership firm as on the date of his retirement i.e., 31.10.2000 and directing the defendants 1 to 6 to jointly and severally pay the said amount to the plaintiff; 1/4

JUDGMENT

The suit is laid for rendition of accounts. The mater is pending since 2004, and the parties have amicably settled the matter outside the Court. The plaintiff now gives his claim against the defendants 3 to 7, in terms of the compromise arrived, and the compromise is fundamentally between the plaintiff and the first defendant, represented by the second defendant, and also by the second defendant in his individual capacity.

2. The Memorandum of Compromise dated 20.09.2021 is filed before the Court, and the parties too are present.

3. This Court interviewed both the plaintiff as well the second defendant, 2/4

and is satisfied that they have amicably settled the matter. The memo of compromise is recorded and taken on file, and a decree be passed.

4. The suit is accordingly decreed in terms of the memo of compromise dated 20.09.2021. No costs.
