Defendant Prayer:- This Civil Suit is filed under Order VII Rule 1 of the Code of Civil Procedure read with Order IV, Rule 1 of the Madras High Court Original Side Rules and Section 13 of the Code of Civil Procedure praying to pass a judgment and decree:(a)directing the defendant to pay the plaintiff a sum of USD $1,315,840(In Indian approximately Rs.5,92,12,800/-)as directed by the judgment of the Superior Court of the State of California, County of Los Angeles, East District dated 8th April, 2003 in case No.KC 038373 as per 1/3

certified copy of the judgment and decree appended to this plaint together with future interest thereon at 7% per annum from this date till realization thereof; (b) directing the defendant to pay the costs of the suit.

JUDGMENT

The learned counsel for the plaintiff has given a letter expressing his desire to withdraw the suit. Necessary endorsement is also made in the plaint.
