J U D G M E N T

The learned counsel appearing for the appellant seeks permission of this Court to withdraw this Second Appeal as it has become infructuous and also made an endorsement in the Appeal to that effect.

In the light of the submission and endorsement made by the learned counsel appearing for the appellant, this Court finds that nothing survives for adjudication in this Second Appeal and accordingly, this Second Appeal stands dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
