The Writ Petition filed under Section 226 of Constitution of India, pleased to issue a writ of certiorarified mandamus

calling for the records in proceedings No.38489/E3/98 dated 7.1.200 made by the 2nd respondent and consequential proceedings dated 22.7.2002 made in M.K.No.1/2000 passed by the fourth respondent and quash the same and treat the document as one of partition and direct the respondents to refund of the excess stamps duty paid valuing Rs.1,24,481/-.

When the matter is taken up for hearing, the learned counsel appearing for the petitioner submitted that initially the document was refused for non payment of stamp duty, however subsequently the petitioner has paid the stamp duty and the documents have been delivered to the petitioner and hence nothing survives in the present Writ Petition for consideration.

2. In view of the above, this Writ Petition is Closed. No costs.
