This Civil Miscellaneous Petition has been filed to condone the delay of 334 days in filing the above appeal.

2. Heard the learned counsel for the petitioner.

3. Mrs.Sree Vidhya, learned counsel takes notice for the 2nd respondent and she has got objection in allowing the application.

4. The sole petitioner would submit that, on account of the amputation of his left leg below the knee, he has lost his earning capacity and has been suffering financially. On that ground, delay of 334 days occurred in filing the Civil Miscellaneous Appeal.

5. Accepting the averments made by the petitioner in the Affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 334 days shall stand waived.
