JUDGMENT
The matter is listed under the caption "for dismissal", today. Even on the last occasion i.e. on 13.09.2019, there was no representation on the side of the appellants.
2. Today, the learned counsel for the appellants submitted that the first appellant died some time back. However, till date no steps have been taken by the learned counsel for the appellants to bring on record the legal heirs of the deceased https://hcservices.ecourts.gov.in/hcservices/
first appellant. Therefore, it can now be inferred that the appellant is not interested to prosecute the Second Appeal. Further no steps have also been taken to bring on record the legal heirs of the deceased first appellant. Accordingly, the Second Appeal shall stand dismissed for non prosecution. No costs.
Consequently, connected miscellaneous petition is closed.
