Respondents Prayer : This petition filed under Article 226 of the Constitution of India to modify para 8 of the order passed by this Court in WP.No.15662 of 2024, dated 14.10.2024, by directing respondents 2 to 5 to send all the original medical records to the 6th respondent, and direct the 6th respondent to process the claim and make payment within a stipulated time frame fixed by this Court. ORDER
When this writ miscellaneous petition came up for hearing on 05.03.2025, this Court passed the following order:
Learned counsel for the petitioner is permitted to serve the papers on Mr.M.Bindran, learned Additional Government Pleader, who appeared on behalf of the respondents 1 to 5 in the main writ petition. 2 / 4
2.The petitioner is seeking for the modification of the order and particularly paragraph No.8 of the order on the ground that the original documents have already been handed over to the 5th respondent and the 5 th respondent through a communication dated 10.12.2021 made to the 2nd respondent has enclosed the entire original documents. 3.In view of the same, the learned counsel for the petitioner submitted that the directions given in paragraph No.8 of the order passed in the writ petition requires modification. 4.Post the miscellaneous petition under the caption 'for orders' on 13.03.2025.
2.It is quite apparent from the communication made by the Assistant Treasury Officer, Salem to the Commissioner of Treasuries and Accounts, Chennai that all the originals were handed over along with the communication dated 10.12.2021. In view of the same, the modification as sought for by the petitioner is granted and the directions given in paragraph 8 of the order dated 14.10.2024 stands modified accordingly.
