Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ, Order or direction in the nature of Writ of Mandamus directing the respondents herein to evaluate petitioner's Allied: Psychological statistics answer sheet having subject code No. 3AA written during the semester examination conducted in December 2020 and consequently to revise the results published for December 2020 examinations in so far as the petitioner is concerned within a time frame fixed by this Hon'ble Court.

ORDER

This Writ Petition has been filed seeking for re-valuation of the marks of the petitioner in respect of the examination in the subject "Psychological statistics - Code No.3AA", which was conducted in December 2020.

2. It is brought to the notice of this Court by the learned Standing counsel appearing for the first respondent university that subsequent to the declaration of results for December 2020 examination for Psychological statistics paper, the petitioner has once again written the very same subject in the subsequent examination conducted in the month of February 2022 and has passed that examination. Learned counsel for petitioner has also, on instructions, agreed that the petitioner has passed the subsequent examination for the very same subject. Learned Standing counsel for the respondent University now submits that the Writ Petition has now become infructuous.

3. Learned counsel for the petitioner, on instructions, would now submit that the petitioner is apprehensive if this Writ Petition is to be decided on merits, in view of the fact that the petitioner has already passed the very same examination subsequent to the December 2020 examination and the petitioner's course is also going to get completed in this academic year.

4. After recording the submissions made by the respective counsels, in view of the fact that the petitioner has successfully passed the Psychological statistics paper subsequent to the impugned examination (December 2020), and she will also be completing the course in this academic year, no useful purpose will be served if revaluation is done in respect of the examination (December 2020), where the petitioner was declared as absent, which is impugned in this Writ Petition.

5. After recording the above submissions, this Writ Petition is disposed of. No costs, Consequently connected miscellaneous petition is closed.
