Contempt Petition filed under Section 11 of the Contempt of Courts Act, to punish the respondents under the Contempt of Courts Act, 1971 for willful and wanton disobedience of the directions/orders, dated 09.01.2024 passed by this Court in WP.No.14989 of 2020.

ORDER

This Contempt Petition was filed on the ground that the order passed by this Court in WP.No.14989 of 2024 dated 09.01.2024, was not complied with. 2.When the matter was taken up for hearing today, the learned Standing Counsel appearing on behalf of TANGEDCO submitted that the condone delay petition is yet to be listed and steps are being taken to get the matter listed before the Division Bench.

3.In the considered view of this Court, the order was passed on 09.01.2024 and this Court while disposing of the writ petition directed the respondents to adjust the excess amount paid by the petitioner towards current consumption charges payable to the Board. Inspite of the same, the current consumption charges are being collected from the petitioner.

4.In view of the fact that the order was passed on 09.01.2024 and the writ appeal filed by the respondent is only at the stage of condone delay, there shall be a direction to the respondents to start adjusting the current consumption charges starting from September 2025 onwards. If in the meantime, they are able to get any interim orders, it goes without saying that the direction given in the writ petition will have to wait till the writ appeal is finally disposed. of 5.With the above directions, this contempt petition is disposed of.
