Respondent PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the respondent police viz the Inspector of Police, Chunambedu police station, Kancheepuram District to produc the vehicle bearing Regn No.TN-10-S-9193 (Tata Indigo) which was seized by the respondent police from the accused in this case concerned in Crime No.429 of 2013 on his file before the Court as per order of the learned Judicial Magistrate, Maduranthakam, Kancheepuram District made in C.M.P.No.6803 of 2013 dated 05.11.2013.

ORDER

The respondent police registered a case in Crime No.429 of 2013 and the petitioner, being a owner of vehicle, has filed a miscellaneous petition under Section 451 r/w 457 of Cr.P.C. for return of his vehicle, which was seized in the above case. The learned Magistrate passed an order in the miscellaneous petition directing the respondent police to produce the vehicle before the Court. Despite, the order of the Court below, the vehicle has not been produced before the Court below and hence the petitioner approached this Court seeking direction to the respondent police to produce the vehicle before the Court below.

When the matter is taken up for hearing, the learned Government Advocate (Crl.Side) submitted that in this case, investigation has been completed and further action dropped, since no case is made out.

in this petition. Hence, this criminal original petition is dismissed as infructuous.
