ORDER

This Criminal Original Petition is filed to modify condition Nos.6(i) and (ii) in the order dated 30.12.2025 passed in Crl.M.P.No.1008 of 2025 in C.N.R.No.TNVL.28-001278-2025, by the learned Special Judge, Special Court for Exclusive Trial of Cases under POCSO Act, Vellore. 2.

The learned counsel appearing for the petitioners submitted that the

petitioners are the accused in Crime No.360 of 2025 for the offences under Sections 111 and 123 of the BNS and Section 77 of the Juvenile Justice (Care and Protection of Children) Act and were arrested on 28.11.2025. The petitioners filed statutory bail application in Crl.M.P.No.1008 of 2025 before the learned Special Judge, Special Court for Exclusive Trial of Cases under POCSO Act, Vellore. The learned trial Judge granted statutory bail to the petitioners with certain conditions. Out of eight conditions, the petitioners have filed this petition to modify the following two conditions viz., "6 (i) On executing a bond for Rs.25,000/- (each) with two sureties for a like sum and one of the sureties must be either blood related or closely related and both of them must be solvent to execute bond:

(ii) - The petitioners shall appear before this court on 10.00 a.m. and 5 p.m., daily without fail, until further orders and they shall not levae Vellore without prior permission of this court." 3.

The learned counsel for the petitioners further submitted that since the petitioners are daily wage earners, they could not mobilise such a huge amount and also they cannot appear daily twice i.e., in the morning and evening, before the trial Court. Therefore, the petitioners seek modification of such conditions.

Learned Government Advocate (Criminal Side) appearing for the respondent submitted that the petitioners cannot approach this Court directly

and they have to approach only the trial Court which has imposed the conditions while granting bail to the petitioners. Therefore, he submitted that this petition is liable to be dismissed.

Considering the fact that this petition has been filed directly before this Court without seeking modification before the trial Court which has passed the order imposing the conditions, this Criminal Original Petition stands dismissed.
