JUDGMENT
(Judgment of the Court was delivered by R.Subbiah, J.) This appeal has been filed by the wife/appellant as against the dismissal of the petition filed by her for divorce under Section 13(1)(i-a)(i-b) of Hindu Marriage Act, in F.C.O.P.No.149 of 2009 by the Family Court Judge at Salem, vide order dated 01.04.2014.
2.Today, when the matter is taken up for hearing, both the parties appeared before this Court along with their respective counsel. The husband/respondent agreed to allow the appeal stating that they have arrived at an amicable settlement. Both the parties filed a joint memo of compromise, wherein it has been stated that during the pendency of the above appeal, on the advice of well wishers and relatives, to give quietus to the disputes existing between the parties, they have agreed to settle all their issues and differences that existed between them; that both the parties agreed that the marriage between https://hcservices.ecourts.gov.in/hcservices/
them solemnized on 23.02.2007 shall be dissolved and that they have no past or future claim against each other. 3.In view of the above settlement entered into between the parties, this appeal is allowed in terms of the joint memo of compromise entered into between the parties. The impugned fair order and decree passed by the Trial Court are set aside. The marriage between the appellant and the respondent solemnized on 23.02.2007 is hereby dissolved. The joint memo of compromise shall form part of the decretal order.
