This petition has been filed to modify the condition imposed on the petitioners in para no.8(a) in Crl.O.P.No.29881 of 2022 on 22.12.2022.

The learned counsel for the petitioners submitted that while granting anticipatory bail to the petitioners, this Court directed the petitioners to deposit a sum of Rs.1,00,000/- (Rupees one Lakh only) to the credit of Crime No.64 of 2022 before the learned Judicial Magistrate No.I, Tiruvallur, within a period of two weeks from the date of receipt of a copy of this order and on such deposit the said amount may be disbursed to the defacto complainant, within a period of two weeks thereafter. Now, the learned counsel for the petitioner submits that the amount be kept in the deposit of Crime No.64 of 2022 before the Judicial Magistrate No.I, Thiruvallur instead of "such deposit the said amount may be disbursed to the defacto complainant within a period of two weeks thereafter. Hence, the modification petition has been filed by the petitioner. 1/3

3. Heard the learned Government Advocate (Crl.Side) appearing for the respondent.

Considering the facts and circumstances of the case, it reveals that the petitioner is directed to deposit a sum of Rs.1,00,000/- (Rupees one Lakh only) to the credit of Crime No.64 of 2022 before the learned Judicial Magistrate No.I, Tiruvallur, within a period of two weeks from the date of receipt of a copy of this order and on such deposit the said amount may be disbursed to the defacto complainant, within a period of two weeks thereafter. Now, the petitioner has failed to comply with the order passed by this Court in Crl.O.P.No.29881 of 2022 dated 22.12.2022, which is unjustifiable one. Hence this Criminal Miscellaneous Petition is dismissed.
