O R D E R

The prayer in the present petition is to call for the records pertaining to the final order relating to the issue dated 26.08.2016 passed in Crl.M.P.No.1856 of 2015 in C.C.No.3839 of 2015 on the file of the XVII Metropolitan Magistrate, Court, Saidapet, Chennai and upon setting aside the same.

2. I do not find any infirmity in the order passed under section 91 Cr.P.C. It is now brought to my knowledge that the proceedings in CC. No. 3839 of 2015 is at the stage of concluding trial. While that being so, it would not be https://hcservices.ecourts.gov.in/hcservices/

appropriate to interfere with the order dated 26.08.2016 passed in Crl.M.P.No.1856 of 2015.

3. Hence the Criminal Original Petition stands dismissed. However, taking in view of the stage of the case, it would be appropriate to direct the learned XVII Metropolitan Magistrate, Saidapet, Chennai to expedite the trial in CC. No. 3839 of 2015 and complete the same within a period of four months from the receipt of copy of this order.
