ORDER
This Writ Petition has been filed seeking a direction to the respondents to transfer the petitioner from Vazhaithottam Panchayat Union Primary School to Batchapettai panchayat Union primary School, Harur Taluk, Dharmapuri District in view of the petitioner's life threatening medical condition, by quashing the impugned order dated 07.08.2025, within a time limit as fixed by this Court.
2. Heard the learned counsels appearing on either side. With the consent of both sides, the Writ Petition is taken up for hearing today at the admission stage itself.
3. The brief facts of the case is as follows: 3.1. The petitioner was initially appointed as Assistant Teacher at Primary School, Chettipattu, Uthangarai Taluk, Dharmapuri District and thereafter promoted as Headmaster in the year 2018. Pursuant to transfer system, she was
transferred to the Panchayat Union Primary School, Paiyarnaickenpatti, a hill station. While so, the petitioner fell seriously ill and her health deteriorated day by day and on diagonalization, it was found that she suffers from Blood Cancer and since there was no medical facilities at the hill station, she sought for transfer from Vazhaithottam Panchayat Union Primary School to the Panchayat Union Primary School, Batchapettai enclosing her medical ailments on 17.05.2024 and further approached this Court by way of filing W.P.No.22965 of 2025, wherein this Court on 26.06.2025 had directed the respondents to consider the petitioner's transfer application sympathetically within six weeks, for which, the present impugned order dated 07.08.2025 has been passed by the fifth respondent stating that there was no vacancy to the post of Headmaster at Batchapettai School. Aggrieved over the same, the present Writ Petition.

The learned counsel for the petitioner submitted that the petitioner is suffering from Blood cancer and she was not able to travel long distance and there is no medical facilities at the Vazhaithotam Panchayat Union Primary School, which is a hill station and hence, requested for transfer to the Batchapettai School, however, without considering all these aspects, the fifth respondent has passed the impugned order rejecting her request and hence, he prayed to quash the same and to grant the relief as sought for by the petitioner in this Writ Petition.

Per contra, the learned Special Government Pleader submitted that there is no vacancy at Batchapettai School now and the respondent will find a nearest place to Batchapettai so as to accommodate the petitioner taking into consideration of her ill health. She further on instructions submitted that the petitioner has submitted her voluntary retirement application.

Considering the facts and circumstances of the case and also taking note of the submissions made by the respective learned counsels, this Court directs the respondents to consider the case of the petitioner for transfer on medical ground and to post her in a nearest place of Batchapettai, within a period of two weeks from the date of receipt of a copy of this order and also to consider her voluntary retirement application sympathetically, as early as possible.
7. With the above directions, the Writ Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. There shall be no order as to costs.
