3. XXX ... Respondents PRAYER: Criminal Original Petition is filed under Section 528 of BNSS, 2023, to call for the records in Crime No.12 of 2024 on the file of the first respondent and quash the same.

For Petitioner : Dr.P.G.Santhosh Kumar For R1 : Mr.A.Gopinath Government Advocate (Crl.side)

ORDER

This petition has been filed to quash the FIR in Crime No.12 of 2024 on the file of the first respondent.

2. Heard the learned counsel for the petitioner and the learned

Government Advocate (Crl.side) for the first respondent and perused the materials placed on record.

3. The case of the prosecution is that the second respondent lodged a complaint stating that her daughter/third respondent is a drums artist. While being so, the petitioner was also part of the troupe. The petitioner, on a false promise of marrying the third respondent had physical relationship with her. Hence, the complaint.

4. The learned counsel for the petitioner would submit that the parties have decided to bury their hatchet and compromise the dispute amicably among themselves.

5. Though, this petition is filed under compromise, on the ground that the victim got married with another person, the petitioner had committed very serious and heinous offence as against the society.

6. In view of the above, this Court is not inclined to quash the FIR in Crime No.12 of 2024 on the file of the first respondent. Accordingly, this

Criminal Original Petition is dismissed.
