PRAYER: The Second Appeal has been filed under Section 100 of C.P.C., to set aside the Judgment and Decree of the Additional Sub Court Mayiladuthurai dated 28.10.1997 confirming the Judgment and Decree of the Additional District Munsif, Mayiladuthurai dated 03.04.1997.

J U D G M E N T

Learned counsel for the appellant submitted that the sole respondent has died and the same has also been intimated to the appellant. Inspite of the same, the appellant has not taken any steps to bring on record the legal representatives of the deceased sole respondent.

In view of the above, the second appeal is dismissed as abated. No costs. Consequently, connected miscellaneous petition is closed.
