Respondent PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for records pertaining to the impugned order of suspension dated 25.09.2025 issued by the respondent vide letter no.bearing NA.KA.NO.1207/2025/A1, and to quash the same and consequently direct the respondent to allow the petitioner to continue in service with all consequential benefits.

O R D E R

Aggrieved by the order of temporary suspension passed by the respondent, the petitioner is before this Court.

2. It is the case of the petitioner that he is working as Supervisor at Kovaipudhur Tasmac Shop, Coimbatore District. During a surprise inspection conducted in the Tasmac Shop, it was found that one T.Velusami, Sales Assistant had collected an additional cost of Rs.10/- per beer bottle over and above the actual price of Rs.170/-, he was proceeded against and the petitioner was also placed under suspension. Subsequently, the respondent issued the order of suspension dated 25.09.2025 to the petitioner, alleging that the petitioner had failed to monitor the sales assistant and had not taken action against him for collecting excess amount. Challenging the said order of suspension, the present Writ Petition has been filed.

Learned counsel appearing for the petitioner submitted that, it was the sales assistant alone who had collected excess amount from the customer however, the petitioner is no way connected with the alleged misconduct as the petitioner was on leave during the relevant period. That being the case, placing the petitioner under prolonged suspension is wholly unsustainable. Accordingly, he prayed for appropriate orders.

4. Learned counsel appearing for the respondent submitted that the issue of revocation of suspension will be considered by the respondent and the petitioner may be directed to submit an appropriate representation seeking revocation of suspension.

In view of the submission made by the learned counsel for the respondent, the petitioner is directed to submit a representation to the respondent seeking revocation of suspension within a period of two (2) weeks from the date of receipt of a copy of this order and upon receipt of such representation, the respondent is directed to consider and pass appropriate orders on the same on merits and in accordance with law within a period of six (6) weeks thereafter.

6. The Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
