Prayer:Second Appeal against the Decree of the Principal District Court, Cuddalore dated 29.07.2008 in A.S.No.63 of 2007 reversing the Judgment and Decree of the Court of the Subordinate Court, Panruti dated 04.09.2007 in O.S.No.24 of 2004.

Decree:This Second Appeal coming on for hearing on this day and upon perusing the Grounds of Appeal,the judgment and decree of the Lower Appellate Court and the Court of First instance material papers in the case and upon hearing the arguments of Mrs.R.Meenal , Advocate for the Appellant and respondent Not appearing either in person or by an Advocate and this Court while allowing this Civil Miscellaneous Appeal,doth order and decree as follows:

i)that the judgment and decree dated 29.07.2008 in A.S.No.63 of 2007 on the file of the Principal District Court, Cuddalore be and hereby is set aside; and this Second Appeal is allowed;

ii)that the judgment and decree dated 04.09.2007 and made in O.S.No.24 of 2004 on the file of the Subordinate Court, Panruti be and hereby is confirmed; and iii)that there be no costs in Second Appeal.
